LIABILITY WAIVER AND TERMS OF AGREEMENT

This Liability Waiver and Terms of Rental Agreement (“Agreement”) is entered into by and between the renter, hereinafter referred to as “Renter,” and Charlotte Mobility Scooter Rentals, a Mobility Scooter Rental Service, hereinafter referred to as “CMSR.”

SCOPE OF AGREEMENT

This Agreement governs the rental of a mobility scooter by the Renter from CMSR, subject to the terms and conditions stated herein. The Renter must be at least 18 years of age at the time of the rental. The rented equipment is the property of CMSR and is in good condition. Renter will return the rented equipment in the same condition as when received, at the end of the rental period for inspection and recharge of battery (if necessary), or sooner, upon the demand by CMSR. Renter shall require drivers to operate the scooter with reasonable care and diligence and comply with the terms of this agreement. Renter shall notify CMSR immediately of any and all accidents and damage resulting from the use, operation or driving of the mobility equipment.

PAYMENT AND FEES

The Renter agrees to pay in full prior to taking possession of the mobility scooter. Payments are to be made through the method specified by CMSR. CMSR accepts most major credit cards for credit identification and payment at the time of rental. Debit Cards can be used as a form of payment of rental charges. Any court costs and any additional fees accrued will be the obligation of the customer.

CANCELLATION POLICY

The Renter may cancel this order at any time; however, the Renter will be charged a cancellation fee of 50% of the rental fee per mobility scooter/electric wheelchair/equipment if not canceled 48 hours prior to the delivery date.

EXTENSION POLICY

Rental extensions are not guaranteed and are based on availability of inventory. The Renter may choose to extend their rental; however, the Renter must notify CMSR at least 48 hours prior to the originally scheduled pick up date. Extensions will be charged the daily rate of the original agreement. CMSR will send a new extension invoice to the Renter. The invoice must be paid prior to the original date of pick up. 

DAMAGE AND LOSS

The Renter shall be responsible for any loss or damage to the mobility scooter during the rental period. CMSR reserves the right to charge the Renter’s card on file in part or in full to cover damages or loss. The Renter understands and authorizes that CMSR will obtain any repair costs or the replacement costs of the mobility scooter/electric wheelchair/equipment. Renter assumes all cost and expenses of every kind and nature, including legal fees and disbursement arising out of and in connection with the use, operation or driving of the mobility equipment. Renter agrees to pay all cost, expenses and attorney fees incurred by CMSR in collecting sums due or in regaining possession of mobility equipment or in enforcing any damage, losses or claims against renter.

USE OF MOBILITY SCOOTER AND RESTRICTIONS

The Renter agrees to operate the mobility scooter in a safe and lawful manner and comply with all applicable laws and regulations. The mobility scooter shall not be used, operated by any person: a) under the age of 18 or b) while under the influence of intoxicants or narcotics; or c) in an unsafe manner. The mobility scooter shall not be used on uneven terrain, submerged in water, or operated in any manner that is abusive or not in accordance with the intended use of the product.

INDEMNIFICATION AND LIABILITY RELEASE

Renter agrees to hold CMSR harmless from and to defend and indemnify CMSR against all claims based upon or arising out of such loss or damage. Renter assumes all risk and liability for any loss, damage or injury, including death, to persons or property of Renter or others arising out of the use, operation or driving of the mobility scooter/electric wheelchair/equipment.

RETURN

The Renter agrees to return the mobility scooter in the same condition as received, barring normal wear and tear, to CMSR at the location and on or before the due date and time. If the scooter is returned dirty with spills or stains, you may be subject to additional charges for cleaning

HOTEL RETURN

If staying in a hotel, on the final day of your rental, please leave the scooter at the front desk no later than noon. This allows us to prepare it for the next guest without delay. Failure to return the scooter on time may result in additional charges.

CHARGING YOUR SCOOTER 

To ensure you're always ready to go, you'll find the scooter's charger either in the front basket or in the pouch behind the seat. Your scooter will have a full charge at of drop-off. We recommend charging the scooter after each use to maintain a full battery. Please unplug the scooter before operating. Before operating, make sure the yellow lever on the back of the scooter is in the “Down” or “Drive” position.

TERMINATION

CMSR reserves the right to terminate this Agreement and repossess the mobility scooter at any time if Renter breaches any term of this Agreement or if the mobility scooter is used in a manner that violates the law or is deemed unsafe by CMSR.

GOVERNING LAW AND JURISDICTION

This Agreement shall be governed by and construed in accordance with the laws of the state of North Carolina, without regard to its conflict of laws principles. Jurisdiction for any disputes arising under this Agreement shall lie within the courts of Mecklenburg County or Gaston County, North Carolina.

ELECTRONIC SIGNATURE

This Agreement can be accepted by electronic signature which has the same legal effect as a handwritten signature.

CREDIT & DEBIT CARD POLICIES

  1. CMSR accepts most major credit cards as credit identification and payment at the time of the rental.
  2. If rented equipment is failed to be returned to the agreed date, CMSR will obtain additional authorizations from renters account to cover the rental charge and the balance of equipment.
  3. Positive identification in addition to ones’ drivers license may be requested.
  4. If cash is used as payment method, a credit/debit card will still need to be recorded in case of damage, theft or a late return.

NO SHOW POLICY

  1. As a courtesy to fellow customers, please cancel any unneeded reservation as soon as your plans change.
  2. A cancellation fee of 50% of the rental fee may be applied if an unwanted reservation is not cancelled before 48 hours to delivery. Call or text the number below for cancellations.
